Evercook Terms of Use

IMPORTANT – PLEASE READ CAREFULLY

These Terms of Use ("Terms") form a legally binding agreement between you and Evercook ("Evercook", "we", "our", or "us") governing your use of:

  • the Evercook mobile application ("App")
  • the Evercook website ("Website")

Together referred to as the "Services".

By accessing or using the Services, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Services.

Certain features of the Services may be subject to additional policies, guidelines, or rules. These additional terms are incorporated into these Terms by reference.

1. Accounts

1.1 Account Registration

Some features of the Services require you to create an account ("Account").

When creating an Account, you agree that:

  • the information you provide is accurate and complete
  • you will keep your account information updated
  • you are at least 18 years old

You may delete your account at any time through the App settings.

Evercook reserves the right to suspend or terminate accounts that violate these Terms.

1.2 Account Security

You are responsible for:

  • maintaining the confidentiality of your login credentials
  • all activities that occur under your Account

You must notify us immediately if you suspect unauthorized access to your account.

Evercook is not responsible for losses resulting from unauthorized account use.

2. Access to the Services

2.1 License to Use

Subject to these Terms, Evercook grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for personal, non-commercial purposes only.

2.2 Restrictions

You agree not to:

  • sell, rent, sublicense, or commercially exploit the Services
  • reverse engineer or attempt to extract source code
  • copy, modify, or distribute parts of the Services
  • build a competing service using Evercook

2.3 Changes to the Services

Evercook may update, modify, or discontinue parts of the Services at any time without prior notice.

2.4 No Guarantee of Support

We may provide updates, support, or maintenance at our discretion, but we are not obligated to do so.

2.5 Ownership

All intellectual property rights in the Services, including software, design, branding, and content provided by Evercook, belong to Evercook or its licensors.

These Terms do not grant you ownership of any intellectual property rights.

2.6 Feedback

If you provide suggestions, feedback, or ideas regarding the Services, you grant Evercook the right to use and incorporate them without restriction or compensation.

3. User Content

3.1 Definition

"User Content" refers to any content submitted or uploaded by users through the Services, including:

  • recipes
  • images
  • text
  • notes
  • imported recipes from external sources

You are solely responsible for the User Content you submit.

3.2 License to Evercook

By submitting User Content, you grant Evercook a worldwide, non-exclusive, royalty-free license to:

  • store
  • reproduce
  • display
  • distribute
  • process

your content for the purpose of operating and improving the Services.

3.3 Responsibility for Content

You agree not to upload or submit content that:

  • is unlawful or harmful
  • infringes third-party rights
  • contains malicious software

3.4 Recipe Sources and Scraping

Evercook allows users to import recipes from:

  • external websites
  • images
  • text input

Users are responsible for ensuring they have the right to use or store such content.

Evercook does not claim ownership of recipes obtained from third-party sources.

3.5 Content Moderation

Evercook reserves the right, but is not obligated, to review, remove, or restrict User Content that violates these Terms.

4. Third-Party Services

The Services may contain links or integrations with third-party websites or services.

Evercook does not control these services and is not responsible for:

  • their content
  • their policies
  • their availability

Your use of third-party services is subject to their own terms and policies.

5. Disclaimers

The Services are provided "as is" and "as available".

To the fullest extent permitted by law, Evercook disclaims all warranties, including:

  • accuracy of recipe information
  • fitness for a particular purpose
  • uninterrupted availability of the Services

Recipes and cooking information are provided for informational purposes only.

6. Limitation of Liability

To the maximum extent permitted by law, Evercook shall not be liable for:

  • loss of data
  • loss of profits
  • damages arising from use of the Services
  • inaccuracies in recipes or extracted content

Your use of the Services is at your own risk.

7. Indemnification

You agree to indemnify and hold Evercook harmless from any claims, damages, or expenses arising from:

  • your use of the Services
  • your User Content
  • your violation of these Terms
  • your violation of any applicable laws.

8. Termination

Evercook may suspend or terminate your access to the Services if:

  • you violate these Terms
  • your use of the Services poses risk to Evercook or other users

You may stop using the Services at any time.

Upon termination, your right to access the Services will end.

9. Changes to These Terms

Evercook may update these Terms from time to time.

If changes are made, the updated Terms will be posted within the Services with a revised "Last Updated" date.

Continued use of the Services after changes indicates acceptance of the updated Terms.

10. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of the applicable jurisdiction where Evercook operates.

Any disputes arising from these Terms shall be resolved through appropriate legal processes within that jurisdiction.

11. Privacy

Your use of the Services is also governed by our Privacy Policy, which explains how we collect and use personal data.
